These services will be delivered in accordance with the standards and expectations of Brimur College. 1.2 Account Creation The Company will assist in the creation of accounts with multiple online tutoring companies. The Tutor agrees to provide accurate personal information and participate in required onboarding processes. 1.3 Subject Selection and Training The Tutor may choose subjects during the application process. In cases where the Tutor may be unqualified or uncertain, Brimur College will provide training to help the Tutor teach additional subjects. 1.4 Exams and Quizzes All exams, tests, and competency assessments required by the tutoring companies will be completed by the Companyās team on behalf of the Tutor, unless otherwise stated. SECTION 2: TERMS OF ENGAGEMENT 2.1 Independent Contractor The Tutor is an independent contractor and is not an employee of Brimur College. As such, the Tutor is responsible for their own taxes, benefits, and insurance. 2.2 Work Schedule The Tutorās work schedule is flexible and will be determined by the availability of work from the assigned tutoring platforms. The Tutor agrees to complete all scheduled tutoring sessions promptly and professionally. 2.3 Work Tiers The Tutor will select one of the following work tiers, which define the extent of their involvement in managing the accounts: Tier 1 (Independent Work): The Tutor will independently manage all assigned accounts and will send 30% of total earnings to Brimur College. The Tutor will receive training for any subjects they cannot teach effectively. Tier 2 (Shared Work): The Tutor will split the work with Brimur Collegeās team. Earnings will be shared 50/50, or split based on the proportion of work done by each party, as determined by mutual agreement. Tier 3 (Passive Income): Brimur College will manage all tutoring activities, and the Tutor will receive 10% of total earnings as passive income. SECTION 3: PAYMENT TERMS 3.1 Compensation The Tutor will be compensated at the rate of $15/hour, on average, depending on the tutoring platform and state. In higher-paying states (California, New York, Washington, etc.), the rate may be higher, depending on the platform. 3.2 Earnings Calculation The Tutorās earnings will be calculated based on the hourly rate provided by the tutoring companies, multiplied by the total hours worked. For Tier 1 and Tier 2 Tutors, compensation will be divided based on the terms outlined above. 3.3 Payment Methods Payments to the Tutor will be made via: First Two Payments: By check sent to the address provided by the Tutor. Subsequent Payments: Through direct deposit into a U.S. bank account or via PayPal. 3.4 Revenue Sharing The Tutor agrees to remit the applicable percentage of their earnings to Brimur College, based on the chosen work tier. Payments to Brimur College are due within 7 business days of receiving payment from the tutoring platforms. SECTION 4: TUTOR OBLIGATIONS 4.1 Professional Conduct The Tutor agrees to conduct themselves in a professional and ethical manner at all times while providing tutoring services. The Tutor is responsible for ensuring that they meet the requirements of the tutoring companies, including punctuality, lesson quality, and adherence to platform guidelines. 4.2 Legal and Regulatory Compliance The Tutor agrees to complete and submit the following forms as part of their engagement with Brimur College: W-9 Form: Required for tax purposes. I-9 Form: Required to verify employment eligibility. Background Check and Fingerprinting: The Tutor agrees to undergo a background check and fingerprinting, with costs covered by Brimur College. 4.3 Confidentiality The Tutor agrees to keep all proprietary information of Brimur College confidential. This includes client information, training materials, and any other sensitive business data shared during the course of this agreement. SECTION 5: COMPANY OBLIGATIONS 5.1 Account Support Brimur College will provide ongoing support to the Tutor by creating and managing accounts on tutoring platforms, handling the onboarding process, and offering training for subjects that the Tutor may not be familiar with. 5.2 Exams and Assessments The Company will ensure that all exams and assessments required by the tutoring platforms are completed on behalf of the Tutor unless otherwise specified. 5.3 Payment Facilitation Brimur College agrees to facilitate payments from the tutoring platforms to the Tutor in a timely manner, in accordance with the payment schedule and methods outlined in Section 3. SECTION 6: TERM AND TERMINATION 6.1 Term of Agreement This Agreement will commence on the Effective Date and will remain in effect until terminated by either party in accordance with this Section. 6.2 Termination by the Tutor The Tutor may terminate this Agreement at any time by providing 30 days written notice to Brimur College. 6.3 Termination by the Company Brimur College may terminate this Agreement at any time for breach of contract, including but not limited to failure to meet the obligations set forth in Sections 4.1 and 4.2, failure to remit payment in accordance with Section 3.4, or breach of confidentiality under Section 4.3. SECTION 7: DISPUTE RESOLUTION 7.1 Mediation In the event of any disputes arising under this Agreement, the parties agree to submit to mediation before initiating any legal proceedings. 7.2 Arbitration If mediation fails, any disputes will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. SECTION 8: LIABILITY AND INDEMNIFICATION 8.1 Limitation of Liability Brimur College will not be liable for any indirect, incidental, special, or consequential damages arising out of or relating to this Agreement. 8.2 Indemnification The Tutor agrees to indemnify and hold Brimur College harmless from any and all claims, damages, losses, liabilities, and expenses arising from the Tutorās performance of tutoring services or breach of this Agreement. SECTION 9: MISCELLANEOUS 9.1 Entire Agreement This Agreement constitutes the entire understanding between the parties and supersedes all prior discussions, agreements, or understandings of any kind. 9.2 Amendments Any amendments to this Agreement must be made in writing and signed by both parties. 9.3 Governing Law This Agreement will be governed by and construed in accordance with the laws of the State of [Insert State], without regard to its conflict of law principles. 9.4 Severability If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.SignaturesPrint Name *FirstLastDate *Submit
